On Wednesday night, 3/30/16, after the 78th Precinct Community Council meeting, I and two others--including Wayne Bailey, who posted the photo below, and Eric McClure--walked to the nearby corner of Sixth Avenue and Dean Street. There we saw, catercorner, several workers on the B3 site, 38 Sixth Avenue. They continued as we watched, from about 8:45 pm- 9 pm.
But were they supposed to be there? There was no after-hours variance for the site (though there were several for the B2 site, 461 Dean, at Dean and Flatbush Avenue). Nor was such work in the two-week Atlantic Yards/Pacific Park Construction Alert.
Only an on-site inspector can determine whether they worked without such a variance--and there wasn't one there--and we don't know the response to the 311 complaint. My query to a representative of the developer got no response. But I do know what we saw.
